Terms of Service

These Terms of Service govern your access to and use of the ORCUS & CORIO online store and your purchase of products from us.

By visiting the store, creating an account or placing an order, you agree to these Terms and to the policies referenced below. Nothing in these Terms limits any mandatory consumer right that cannot legally be excluded.

1. About ORCUS & CORIO

In these Terms, “ORCUS & CORIO”, “ORCUS”, “we”, “us” and “our” refer to the operator of the ORCUS & CORIO online store. “You” and “customer” refer to the person accessing the store or purchasing a product.

2. Eligibility and acceptable use

You must have reached the legal age required to enter into a purchase contract in your place of residence, or place an order with the involvement of a parent or legal guardian where permitted by law.

You may use the store only for lawful personal or business purchasing purposes. You must provide accurate information and must not misuse the store, interfere with its operation or attempt to access systems or data without authorisation.

3. Products and natural variations

We aim to describe and display each product as accurately as reasonably possible, including its principal materials, dimensions, colours and functions. Screen settings, lighting and photography may affect how a colour appears.

Leather and other natural or textured materials may show variations in grain, tone, markings and patina. These characteristics may form part of the material’s individual appearance and are not automatically manufacturing defects. This does not affect your rights where a product is defective or materially different from its description.

4. Availability and Drops

Products are offered subject to availability. A Drop or Run may contain a fixed quantity and may be archived when that Run ends. Archiving does not necessarily mean that the same piece will never return in a future Run.

Adding an item to a cart does not reserve it. We may introduce purchase limits where reasonably necessary to maintain fair availability or prevent resale, misuse or fraud.

5. Prices, currencies and charges

Product prices are displayed in the currency selected or made available for your market. Prices may change at any time, but a change will not affect an order that we have already accepted, except where a correction is required by law or an obvious pricing error has occurred.

Applicable shipping charges and taxes collected by us will be shown at checkout before you confirm payment. If import duties or local charges are not collected at checkout, you may be responsible for them where this is disclosed and permitted by applicable law. Your bank or payment provider may apply separate currency or transaction fees that are outside our control.

6. Orders and contract formation

When you submit an order, you offer to purchase the selected products under these Terms. An acknowledgement or payment authorisation does not necessarily mean that the order has been accepted. Acceptance occurs when we confirm that the order has been accepted or dispatched, subject to any mandatory rule that applies in your market.

We may refuse or cancel an order for a legitimate reason, including unavailable stock, an obvious pricing or description error, payment failure, suspected fraud, sanctions restrictions, unusual quantities or an inability to deliver to the supplied address. If we cancel an order after payment, we will return the amount collected for the cancelled item through the appropriate payment method.

Please review your name, email, telephone number and delivery address carefully. Contact us immediately if a correction is required. We cannot guarantee a change or cancellation once fulfilment or dispatch has begun.

7. Payment

Available payment methods are displayed at checkout. You authorise us and the relevant payment provider to charge the total amount shown before order confirmation. Payment may be subject to authentication, fraud-prevention checks and the provider’s own terms.

You confirm that you are authorised to use the selected payment method. We may suspend processing while a payment or identity check is completed.

8. Fulfilment, shipping and delivery

Orders may be stored, prepared and shipped by third-party warehousing, fulfilment and courier partners. This means that an order may be dispatched from a location different from the location of the ORCUS operating entity.

Delivery destinations, current estimates, charges, tracking information and delay conditions are described on our Shipping & Delivery page. Delivery dates are estimates unless we expressly confirm a guaranteed date.

You are responsible for providing a complete and accessible delivery address and for following reasonable courier instructions. Additional delivery or return costs caused by an incorrect address, repeated failed delivery or unjustified refusal may be charged to you where permitted by law and disclosed before redelivery.

Delivery is completed when you, or a person designated by you, takes physical possession of the parcel, subject to applicable consumer law.

9. Inspection on delivery

Please inspect your parcel promptly. If an item is missing, incorrect or appears damaged in transit, contact us within the period stated in our Returns Policy and provide the order number, a description and clear photographs or video of the item, packaging and delivery label. Keep the packaging until the claim has been reviewed. A reporting period does not remove any longer mandatory right provided by law.

10. Exchanges, returns and refunds

Eligibility, time limits, item-condition requirements, exclusions, return costs and refund procedures are set out on our Exchanges & Returns page, which forms part of these Terms.

Do not send an item before receiving return authorisation and the correct return instructions. Where a refund is approved, it will normally be issued to the original payment method, subject to processing times and applicable law.

11. Two-year limited warranty

ORCUS products are covered by a limited two-year commercial warranty from the original purchase date. This warranty applies only to confirmed manufacturing, assembly or material defects that cause abnormal or premature failure under normal use.

The warranty does not cover normal wear, leather patina, scratches, softening, deformation, colour variation or fading; accidental damage; impact; overloading; repeated abrasion; exposure to water, humidity, heat, direct sunlight, oils or corrosive substances; improper care; loss or theft; or unauthorised alterations and repairs.

A claim requires proof of purchase, a detailed description and clear photographs or video. If approved, ORCUS will determine an appropriate remedy according to the defect and applicable law, which may include repair where available, replacement or another legally required remedy.

This commercial warranty is additional to, and does not replace or restrict, mandatory legal rights relating to defective or non-conforming goods.

12. Product care and intended use

Products must be used for their intended purpose and according to any care instructions supplied with the item. Avoid overloading and prolonged exposure to water, humidity, heat, direct sunlight, oils and abrasive surfaces. Improper use may reduce product life and may affect eligibility under the commercial warranty, without limiting mandatory rights.

13. Gifting

Gift packaging, personal messages and recipient-delivery options are available only when displayed on the relevant product page or at checkout. You are responsible for ensuring that recipient details and any message are accurate, lawful and appropriate. Returns and warranty claims remain subject to the applicable policies and may require the original order information or proof of purchase.

14. Intellectual property

The store and its content—including the ORCUS & CORIO name, OC monogram, product names, designs, photographs, videos, text, graphics and layout—are owned by or licensed to ORCUS and are protected by applicable intellectual-property laws. You may use the store for personal, non-commercial shopping purposes. No content may be copied, reproduced, distributed, altered, scraped or commercially exploited without prior written permission, except as permitted by law.

15. Reviews and submitted content

If you submit a review, image, message or other content for publication, you confirm that you own it or have permission to use it and that it is accurate, lawful and does not infringe another person’s rights.

You grant ORCUS a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for operating and promoting the store, subject to our Privacy Policy and any applicable consent requirements. We may decline or remove unlawful, misleading, abusive, irrelevant or infringing content.

16. Third-party services and links

The store may use or link to services operated by third parties, including Shopify, payment providers, social platforms and delivery-tracking services. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party websites that we do not control, but this clause does not exclude our responsibility for selecting and managing service providers where the law requires it.

17. Errors and store availability

We may correct typographical errors, inaccuracies or omissions and update store information. We do not guarantee that the store will always be uninterrupted or error-free. Where an error affects an order, we will contact you and provide an appropriate option, such as confirming corrected information or cancelling and refunding the affected order.

18. Liability

Nothing in these Terms excludes or limits liability where exclusion is prohibited, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or breach of mandatory consumer rights.

To the fullest extent permitted by law, ORCUS is not responsible for losses that were not reasonably foreseeable when the contract was formed, or for indirect, incidental or consequential business losses arising from a consumer purchase.

Where the law permits a financial limitation, ORCUS’s aggregate liability relating to a product or order will not exceed the amount paid for the affected product. This limitation does not apply where applicable law requires a greater remedy.

19. Events outside reasonable control

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, transport interruption, customs action, labour disruption, public-authority measures, telecommunications failure, epidemic, conflict or natural disaster. We will take reasonable steps to reduce the impact and will inform affected customers where appropriate. Your mandatory cancellation or refund rights remain unaffected.

Our collection and use of personal information are described in our Privacy Policy .

21. Governing law and disputes

These Terms and purchases made through the store are subject to the laws applicable to the legal entity operating ORCUS & CORIO. Regardless of that governing law, you retain any mandatory consumer protection available in the country or region where you live when that protection legally applies.

Please contact us first so that we can try to resolve a complaint directly. If a dispute cannot be resolved, it may be referred to the competent court or recognised alternative dispute-resolution body determined by applicable law.

22. General provisions

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision immediately is not a waiver of the right to enforce it later.

These Terms, together with the policies and product-specific conditions referenced in them, form the agreement between you and ORCUS concerning use of the store and purchases. If a product-specific term conflicts with these general Terms, the more specific term applies to that product, subject to mandatory law.

23. Changes to these Terms

We may update these Terms to reflect changes to our store, services or legal obligations. The current version will be published on this page with a revised “Last updated” date. Changes will not retroactively reduce rights relating to an order already accepted unless the law permits or requires that change.
